Appellant John Anthony Saenz was convicted of three counts of capital murder and sentenced to three concurrent terms of life imprisonment. On appeal, Saenz argues that the trial court should not have entered three separate judgments and sentences and that by doing so, the trial court violated his double jeopardy rights. Additionally, Saenz complains of instructions given to the jury by the trial court. Finally, Saenz argues that the evidence is factually insufficient to support his convictions. Because Saenzs double jeopardy argument has merit, we affirm the judgment on count I, but reverse and render judgments of acquittal with respect to counts II and III.
